Trial against Albin Kurti suspended as a result of lawyers moral disobedience
The assigned lawyer Fetije Ukaj did not attend court in an act of moral disobedience. As threatened, in the meantime, the Court had called the President of the Bar Association, Ramë Gashi, to attend. Mr Gashi wrote a letter to the Court in which he personally refused to take part in the trial because he argued it was not possible to provide Albin with an effective defense. Furthermore, he stated that the Bar Association would not agree to assign any other lawyer to take part in the case. The Court was adjourned for 45 minutes after which it ruled that the trial would be
suspended due to the obstruction of the defense lawyers. This suspension remains effective until this situation changes, ie. until a defense lawyer agrees to participate. Based upon todays events and the record of moral disobedience by all lawyers assigned so far, with the exception of Fazli Balaj who was dismissed for bias against Albin, it is very unlikely that any Albanian lawyer will ever agree to participate in this political trial. Albin was released from detention and the court stated that it would send a note of the verbal proceedings of the day to the SRSG, the Supreme Court of Kosova, the Department of Justice and the Parliamentary
Committee of Justice.
Today Albanian lawyers chose the justice of the people of Kosova over the unjust system of UNMIK. They chose to serve justice, in line with their ethical and professional responsibility, instead of acting as agents of an unjust law. Their solidarity and moral disobedience forced the collapse of the political trial against Albin Kurti. Through their actions they have today defended the right of all people in Kosova to demonstrate and act peacefully for their political beliefs. It is through principled non-cooperation such as this that injustice is defeated.
